A Rent Agreement is a written contract between the landlord and tenant defining the terms of tenancy. It normally covers rent, security deposit, duration, maintenance, utilities, notice period and other conditions.
The agreement should clearly mention the property details and identity/address of both parties. Stamp duty is payable as applicable under the relevant State law. An inadequately stamped document can create legal/evidentiary problems.
Under the Registration Act, leases exceeding one year, year-to-year leases, or leases reserving yearly rent generally require registration. Leases up to one year fall under the category where registration is optional under Section 18.
The commonly used 11-month agreement is not automatically a universal “registration-free” rule; state-specific laws and the exact terms of the tenancy should be checked.
A properly drafted agreement helps prevent disputes and protects the interests of both landlord and tenant.
Keep copies of the signed agreement, stamp/registration proof and identity/address documents of the parties.
