MCA Penalizes Company For Failing To Print CIN On Letterhead

The Registrar of Companies (ROC), Delhi & Haryana, issued an adjudication order against Shivnath Holdings Private Limited for breaching Section 12(3)(c) of the Companies Act, 2013, by not including its Corporate Identity Number (CIN) on its official letterhead. This decision followed instructions from the Regional Director (RD), prompted by an inspection report under Section 206 of the Companies Act, 2013.

A Show Cause Notice (SCN) was issued on 23.02.2023 but was only partially delivered. Despite email service, no response was received initially. A second notice dated 25.05.2023 was later served, and the company replied on 06.06.2023, admitting to the violation.

According to the adjudication order, Shivnath Holdings Private Limited has been categorized as a small company. As a result, the penalty imposed was reduced. The company, along with its directors, Isha Garg and Mahesh Chander, has been directed to pay the reduced penalty within 90 days.

Additionally, the company is instructed to rectify the default by ensuring the CIN is printed on all official letterheads and to file the required e-form. The order also provides details regarding the procedure to appeal before the Regional Director if desired.
