The Ministry of Communications recently issued the Telecommunications (Procedures and Safeguards for Lawful Interception of Messages) Rules, 2024.

Under the Telecommunications Act, 2023, these rules establish procedures for lawful interception by authorized agencies to protect national security while ensuring confidentiality. Interception requires specific orders from the Union or State Home Secretary. Temporary interception is allowed in exceptional cases but must be confirmed to remain valid.

Interception orders must adhere to strict documentation, limited usage, and a validity of up to 180 days. Agencies are required to secure and maintain records of intercepted communications, ensuring their destruction within set timelines. Safeguards include strict confidentiality, access only by authorized personnel, and thorough internal checks.
